Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the application "sand1" (the "App") provided by Tetsuro Miyagawa (the "Operator"). You must accept these Terms before you can use the App; if you do not accept them, you may not use the App.

There is zero tolerance for objectionable content and for abusive users. Content that violates Section 4 is removed, and the user who posted it is ejected from the service.

1. The Service

The App lets you post a short, anonymous word (up to 30 characters) near your current location, and shows gatherings of the same word on a map as a "trend".

2. Eligibility

The App is intended for users aged 18 and over. You may not use the App if you are under 18.

3. Anonymity and Location

No account registration is required to use the App. You are identified by an anonymous ID issued per installation, and that ID is never shown to other users.

For the location attached to a post, only a value rounded on your device to a grid of roughly 150 meters is sent to and stored on the servers. Your precise location is never stored on the servers.

4. Prohibited Conduct

The Operator has no tolerance for objectionable content or abusive behaviour. When using the App, you must not:

1. Violate any law or public order and morals;

2. Defame, discriminate against, threaten, or harass any individual or organization;

3. Post obscene, violent, or grotesque content;

4. Post personal information about yourself or others (such as names, addresses, phone numbers, or affiliations, or any information that could identify an individual);

5. Impersonate another person;

6. Post spam, advertising, promotion, or solicitation;

7. Post false information about disasters, incidents, or emergencies;

8. Gain unauthorized access to the App's systems, reverse engineer them, or place an excessive load on them; or

9. Engage in any other conduct the Operator deems inappropriate.

5. Your Posts

Posts are published anonymously and appear on other users' maps as part of a "trend".

The Operator may use your posts free of charge (including displaying, reproducing, aggregating, and quoting them) for the purpose of providing, improving, and promoting the App.

Posts and trends are deleted automatically after a period of time.

You can remove your own post at any time from the detail sheet of the trend it belongs to. Removal takes effect immediately for everyone.

6. Moderation

Posts are screened before and after they are sent: personal information is checked on your device, and abusive or discriminatory words are rejected by both the App and the servers.

A trend, or an individual post inside a trend, that receives a certain number of reports from users is hidden automatically for everyone, without any operator action.

The Operator reviews reports of objectionable content and acts within 24 hours, removing the content and ejecting the user who posted it.

The Operator may remove posts that violate these Terms and suspend a violating user's access (including prohibiting them from posting) without prior notice.

6-2. Tools Available to You

Report - every trend and every individual post can be reported, with a reason.

Hide - every trend and every individual post can be hidden on your device.

Block - you can block the author of any post. Their posts never appear for you again. Blocks can be cleared from Settings.

Remove your own post - see Section 5.

Contact the Operator - a contact form is built into the App (Settings -> Contact the Operator); it delivers your message straight to the Operator. See "Contact Us" below for the alternative.

7. Disclaimer

Information posted in the App is submitted anonymously by users. The Operator does not warrant its accuracy or usefulness.

In an emergency such as a disaster or accident, rely on announcements from public authorities rather than on information in the App.

Except in cases of the Operator's willful misconduct or gross negligence, the Operator is not liable for interruption or termination of the App, loss of data, or any damage arising from your use of the App.

The Operator is not responsible for disputes between users, or between a user and a third party.

8. Changes to and Termination of the Service

The Operator may change the content of the App, or suspend or terminate its provision, without prior notice to users.

9. Changes to These Terms

The Operator may amend these Terms when it deems it necessary. Amended Terms take effect when posted on this page or within the App.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. In the event of a dispute concerning the App, the court having jurisdiction over the Operator's location shall be the exclusive court of first instance by agreement.
